1. Scope of Application
These General Rental Terms and Conditions apply to all rental agreements for sports equipment between CPS Handels GmbH, Schattau 90, 5442 Rußbach, Austria (hereinafter referred to as the "Lessor") and the respective renter.
By reserving or taking possession of the rental equipment, the renter acknowledges and agrees to these Terms and Conditions as legally binding.
2. Reservation and Conclusion of the Rental Agreement
A reservation becomes valid upon receipt of the reservation request by the Lessor or upon receipt of a booking confirmation.
The rental agreement is concluded between the customer making the reservation and CPS Handels GmbH.
The Lessor reserves the right to decline reservations without stating a reason.
3. Rental Fees and Payment Terms
The rental fee must be paid directly at the rental shop unless otherwise agreed.
Prices are based on the current valid price list.
For rentals starting after 3:00 PM, the rental period will be charged from the following calendar day.
If the equipment is returned before 9:00 AM, the current calendar day will not be charged.
4. Proof of Identity
At the start of the rental period, the renter must present a valid government-issued photo ID (passport or driver's license).
The renter agrees that, where legally permitted, a copy of the identification document may be made and stored for the purpose of securing the rental agreement.
5. Condition and Acceptance of the Rental Equipment
By taking possession of the rental equipment, the renter confirms that it is in proper condition.
Any defects or damage must be reported immediately at the time of handover.
6. Duty of Care and Liability of the Renter
The renter is fully responsible for the rented sports equipment throughout the entire rental period.
The equipment may not be transferred or lent to third parties.
The renter undertakes to use the equipment properly and to store it with due care at all times.
The renter is liable for any damage, loss, or theft occurring during the rental period, unless it results from normal wear and tear.
Improper use (e.g. skiing on gravel-covered roads) entitles the Lessor to charge the costs of repair or replacement.
7. Theft and Loss
In the event of theft, the renter must report the incident to the competent police authority within 24 hours.
A copy of the police report must be provided to the Lessor.
If no insurance has been taken out, the following flat-rate charges will apply:
Premium Category: EUR 350
Sport Category: EUR 250
Top Category: EUR 150
The Lessor reserves the right to claim compensation for any actual damage exceeding these amounts.
8. Rental Insurance
The rental equipment is not insured by default.
For an additional fee of 10% of the rental price, insurance against accidental damage and theft may be purchased.
The insurance does not cover damage caused by gross negligence or improper use.
9. Ski Binding Adjustment
Ski bindings are adjusted in accordance with applicable standards based on the information provided by the renter, in particular their weight, height, age, and skiing ability.
The renter confirms that all information provided is accurate.
Any unauthorized adjustment of the ski binding settings is prohibited and is carried out entirely at the renter's own risk.
10. Equipment Exchange
The rented sports equipment may be exchanged during the rental period.
If the renter upgrades to a higher equipment category, the corresponding surcharge according to the current price list must be paid.
11. Return of Equipment
The rented equipment must be returned at the agreed time.
If the equipment is returned late, the rental fee will be charged for the additional rental period.
If the equipment is not returned without a valid reason, the Lessor reserves the right to report the matter to the authorities on suspicion of unlawful appropriation.
12. Duty to Safeguard the Equipment
The renter must store the rented sports equipment in a manner that prevents theft or accidental mix-ups.
Skis should be stored separately from one another or secured in designated ski lockers.
Overnight, the equipment must be kept in a locked room or inside a locked vehicle.
13. Non-Use / Weather Conditions
No refund will be granted if the rented sports equipment is not used due to unfavorable weather conditions.
If the equipment cannot be used due to illness or an accident, the rental fee for the remaining rental period will be refunded upon presentation of a valid medical certificate.
In the event of a complete closure of the Dachstein West ski area, any remaining rental days will be refunded upon presentation of a confirmation issued by the ski lift operator.
14. Liability of the Lessor
The use of the rented equipment is at the renter's own risk.
The Lessor shall only be liable for damages caused by intentional misconduct or gross negligence.
Liability for personal injury remains unaffected.
15. Data Protection
Personal data is processed in accordance with the applicable national and European data protection laws.
The data is processed solely for the purpose of fulfilling the rental agreement and handling reservations.
Personal data will only be disclosed to third parties where required by law or necessary for the performance of the contract.

16. Governing Law and Jurisdiction
These Rental Terms and Conditions shall be governed exclusively by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The Lessor is entitled to bring legal proceedings against the renter at the renter's place of residence or before any other court having jurisdiction under applicable law.
For consumers, the mandatory jurisdiction provisions of the Austrian Consumer Protection Act (Konsumentenschutzgesetz) shall apply.
