General Rental Terms and Conditions (Rental T&Cs)<\/h1>\t\t\t\t<\/div>\n\t\t\t\t
\n\t\t\t\t\t\t\t\t\t

1. Scope of Application<\/strong>
\nThese General Rental Terms and Conditions apply to all rental agreements for sports equipment between CPS Handels GmbH, Schattau 90, 5442 Ru\u00dfbach, Austria (hereinafter referred to as the \"Lessor\") and the respective renter.
\nBy reserving or taking possession of the rental equipment, the renter acknowledges and agrees to these Terms and Conditions as legally binding.<\/p>

2. Reservation and Conclusion of the Rental Agreement<\/strong>
\nA reservation becomes valid upon receipt of the reservation request by the Lessor or upon receipt of a booking confirmation.
\nThe rental agreement is concluded between the customer making the reservation and CPS Handels GmbH.
\nThe Lessor reserves the right to decline reservations without stating a reason.<\/p>

3. Rental Fees and Payment Terms<\/strong>
\nThe rental fee must be paid directly at the rental shop unless otherwise agreed.
\nPrices are based on the current valid price list.
\nFor rentals starting after 3:00 PM, the rental period will be charged from the following calendar day.
\nIf the equipment is returned before 9:00 AM, the current calendar day will not be charged.<\/p>

4. Proof of Identity<\/strong>
\nAt the start of the rental period, the renter must present a valid government-issued photo ID (passport or driver's license).
\nThe renter agrees that, where legally permitted, a copy of the identification document may be made and stored for the purpose of securing the rental agreement.<\/p>

5. Condition and Acceptance of the Rental Equipment<\/strong>
\nBy taking possession of the rental equipment, the renter confirms that it is in proper condition.
\nAny defects or damage must be reported immediately at the time of handover.<\/p>

6. Duty of Care and Liability of the Renter<\/strong>
\nThe renter is fully responsible for the rented sports equipment throughout the entire rental period.
\nThe equipment may not be transferred or lent to third parties.
\nThe renter undertakes to use the equipment properly and to store it with due care at all times.
\nThe renter is liable for any damage, loss, or theft occurring during the rental period, unless it results from normal wear and tear.
\nImproper use (e.g. skiing on gravel-covered roads) entitles the Lessor to charge the costs of repair or replacement.<\/p>

7. Theft and Loss<\/strong>
\nIn the event of theft, the renter must report the incident to the competent police authority within 24 hours.
\nA copy of the police report must be provided to the Lessor.
\nIf no insurance has been taken out, the following flat-rate charges will apply:
\nPremium Category: EUR 350
\nSport Category: EUR 250
\nTop Category: EUR 150
\nThe Lessor reserves the right to claim compensation for any actual damage exceeding these amounts.<\/p>

8. Rental Insurance<\/strong>
\nThe rental equipment is not insured by default.
\nFor an additional fee of 10% of the rental price, insurance against accidental damage and theft may be purchased.
\nThe insurance does not cover damage caused by gross negligence or improper use.<\/p>

9. Ski Binding Adjustment<\/strong>
\nSki bindings are adjusted in accordance with applicable standards based on the information provided by the renter, in particular their weight, height, age, and skiing ability.
\nThe renter confirms that all information provided is accurate.
\nAny unauthorized adjustment of the ski binding settings is prohibited and is carried out entirely at the renter's own risk.<\/p>

10. Equipment Exchange<\/strong>
\nThe rented sports equipment may be exchanged during the rental period.
\nIf the renter upgrades to a higher equipment category, the corresponding surcharge according to the current price list must be paid.<\/p>

11. Return of Equipment<\/strong>
\nThe rented equipment must be returned at the agreed time.
\nIf the equipment is returned late, the rental fee will be charged for the additional rental period.
\nIf the equipment is not returned without a valid reason, the Lessor reserves the right to report the matter to the authorities on suspicion of unlawful appropriation.<\/p>

12. Duty to Safeguard the Equipment<\/strong>
\nThe renter must store the rented sports equipment in a manner that prevents theft or accidental mix-ups.
\nSkis should be stored separately from one another or secured in designated ski lockers.
\nOvernight, the equipment must be kept in a locked room or inside a locked vehicle.<\/p>

13. Non-Use \/ Weather Conditions<\/strong>
\nNo refund will be granted if the rented sports equipment is not used due to unfavorable weather conditions.
\nIf the equipment cannot be used due to illness or an accident, the rental fee for the remaining rental period will be refunded upon presentation of a valid medical certificate.
\nIn the event of a complete closure of the Dachstein West ski area, any remaining rental days will be refunded upon presentation of a confirmation issued by the ski lift operator.<\/p>

14. Liability of the Lessor<\/strong>
\nThe use of the rented equipment is at the renter's own risk.
\nThe Lessor shall only be liable for damages caused by intentional misconduct or gross negligence.
\nLiability for personal injury remains unaffected.<\/p>

15. Data Protection<\/strong>
\nPersonal data is processed in accordance with the applicable national and European data protection laws.
\nThe data is processed solely for the purpose of fulfilling the rental agreement and handling reservations.
\nPersonal data will only be disclosed to third parties where required by law or necessary for the performance of the contract.

16. Governing Law and Jurisdiction<\/strong>
\nThese Rental Terms and Conditions shall be governed exclusively by Austrian law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
\nThe Lessor is entitled to bring legal proceedings against the renter at the renter's place of residence or before any other court having jurisdiction under applicable law.
